ORDER: Defendants' 31 motion to compel plaintiff's deposition on a date certain is hereby granted. The Court will afford plaintiff one last chance to appear for his deposition. Therefore, plaintiff is hereby ordered to timely appea r for his deposition on April 5, 2010 at 10:00 a.m. Defendants' counsel shall notice plaintiff accordingly. This is a Court Order and plaintiff must comply. If plaintiff fails to appear for his Court-ordered depositio n on 4/5/2010, and fails to stay for seven hours to complete his deposition, this Court will recommend that his case should be dismissed. Finally, in light of this Order, discovery is hereby extended until 4/5/2010 for the purpose of completing plaintiff's deposition. SO ORDERED. ORDER, The Court held a status conference on 12/9/09. Pltff stated that he had not produced his initial disclosures to defts' counsel as directed by the Court. Therefore, the Court directed pltff to provide defts' counsel with his initial d isclosures by 12/29/09, and set 4/1/10 as the deadline for the parties to complete all discovery. Any request to file a second amended complaint, including any request to join other parties, shall be made by 1/8/10. Since 4/1/10 is the deadline for t he completion of all discovery, requests to the opposing party must be served at least 30 days before that deadline. The parties may conduct depositions upon oral examination to FRCP 30. Defts shall contact Judge Townes to request a pre-motion conference by 4/29/10 if they intend to move for summary judgment. MEMORANDUM AND ORDER, that, to the extent pltff seeks to bring claims pursuant to Title VII against defts Kenny Kaye, Fernando Ramirez, Mrs. Wingate, Mrs. Peters, Robert McCantee, Carla Warren, and Director Dawn M. Pinnock, those claims are dismissed ; and further ORDERED, that the Clerk of Court shall issue summons with respect to all defts. The summons issued with respect to deft McCantee shall reflect his true name, Robert McEntee. The US Marshals Service is hereby directed to serve these summ ons, along with the Amended Complaint and a copy of this Memorandum and Order, on all defts, and it is further ORDERED that this case is referred to Magistrate Judge Bloom for all pretrial proceedings.
