ORDER: Although it was past the deadline, on 6/1/2010, plaintiff filed a 44 motion to amend his complaint. Defendants do not object to the proposed amendment. The Court therefore grants plaintiff's 44 motion to amend. Defendants' 48 request to compel plaintiff to respond to their discovery demands is granted. Defendants shall answer the amended complaint and re-serve their outstanding discovery demands on plaintiff by 6/21/2010. The Court hereby extends the discovery deadline to August 2, 2010. Plaintiff must respond to defendants' interrogatories and demand for production of documents by July 19, 2010. Although plaintiff has not yet responded to defendants' discovery demands, defendants' counse l shall notice plaintiff for his deposition on a date certain before 8/2/2010. Should plaintiff fail to respond to defendants' discovery requests by 7/19/2010 or to timely appear for his deposition, the Court will recommend that plaintiff's case should be dismissed. SO ORDERED. ORDER, Pltff stated that he mailed the Court notice of his current address at Clinton Correctional Facility, 10-A-0430, P.O. Box 2000, Dannemora, NY 12929. Although, the Court has not yet received pltff's notice, the Clerk of Court shall update pltff's address on the docket. The Court set 7/19/10 as the deadline for the parties to complete all discovery. Any request to amend the complaint, including any request to join other parties, shall be made by 4/9/10. Since 7/19/10 is the deadl ine for the completion of all discovery, requests to the opposing party must be served at least 30 days before that deadline.
