ORDER GRANTING IN PART AND DENYING IN PART PETITION FOR WRIT OF HABEAS CORPUS PURSUANT TO 28 U.S.C. § 2255 -- The petition for relief pursuant to 28 U.S.C. § 2255 is granted in part and denied in part. The Court finds Petitioner was denie d effective assistance of appellate counsel. Accordingly, Petitioner's counsel is directed to move the Second Circuit Court of Appeals to recall its mandate and reinstate Petitioner's appeal. The petition is denied as to Petitioner's claim of ineffective assistance of trial counsel. The Clerk of the Court is directed to close this case.
