ORDER denying 44 Plaintiff's Motion for Discovery. Because Plaintiff has not justified his failure to timely obtain the documents he now seeks to subpoena, and because of the undue and unfair prejudice that would result if he were permitted to do so at this time, the Court denies Plaintiff's request for leave to serve a third-party subpoena.
