ORDER granting in part and denying in part 30 Motion for Partial Summary Judgment: As discussed in the attached M & O, Defendants' motion for partial summary judgment is denied in part, and granted in part. The parties shall proceed to trial on: (1) Plaintiffs' false arrest claim against Defendant-Officers Perez and Ambrosino; (2) the excessive force claim against Defendant-Officer Perez; (3) the federal and State law abuse of process claims against all Defendants; and, (4) the State law claim for loss of consortium against all Defendants.
