ORDER granting in part and denying in part 13 Motion to Dismiss for Failure to State a Claim: For the reasons explained in the attached Memorandum and Order, UBS's motion to dismiss is granted with respect to Royal's anticipatory breach of contract claim, which is hereby dismissed without leave to replead. UBS's motion is otherwise denied, because Royal has alleged plausible claims for both breach of contract and breach of the implied covenant of good faith. Ordered by Judge John Gleeson on 7/31/2012.
