January 22, 2014 Minute Entry for proceedings held before Magistrate Judge Robert M. Levy: Todd Bank, Esq., pro se; Jeffrey Backman. All 6 outstanding discovery motions have been resolved. Each ruling was made on the record. A summary of some of the rulings follows. (1) Plaintiff's deposition will be held on 2/26/14. No adjournments without the court's express written approval. (2) The discovery deadline is extended to 2/26/14. Except for limited follow-up discovery requests for documents or information arising from the deposition, no further discovery will be permitted. (3) Plaintiff has waived the 30(b)6) deposition of the corporate defendant. (4) Defendant shall submit a declaration that it has deleted the telephone records it received in response to a subpoena to Ooma and that it has retained no copies or portions of copies of such records. Defendant shall forward a complete copy of the subpoenaed records to plaintiff and to the court. The records sent to the court will be contained in a sealed envelope with the instruction not to open unless there is a discovery dispute concerning the records. Plaintiff will then redact the telephone numbers of family, friends, medical providers and religious organizations and forward the redacted records to defendant's counsel. Plaintiff will also send to the court, in camera, the redacted production and a sealed list of numbers, identifying who they belong to and the category to which they belong. The court will maintain the list in the event of disputes. (5) With respect to DKT 30, defendant will briefly define the headings in columns A,B,C,D, and E, as explained at the conference. Additionally, defendant will identify the entity at 1170 Tree Swallow Drive and the type of goods or services it provides. With respect to Interrogatory 9, defendant will confirm that it has made full corporate disclosure, and supplement if necessary with respect to any of the entities listed in Interrogatory 9. (6) On or before 1/24/14, plaintiff will advise in a verified response whether he has withheld any information in response to the discovery requests in DKT 26-6 on the basis of privilege or any of the general objections plaintiff has asserted. (7) Next conference 2/27/14 at 2:30 (brief status conference)(tel).
