April 22, 2013 Opinion or Order Filing 7 [AMENDED] MEMORANDUM AND ORDER: Plaintiff is granted 3 leave to proceed in forma pauperis under 28 U.S.C. § 1915. Plaintiff's complaint is dismissed as to President Barack Obama pursuant to 28 U.S.C. §1915(e)(2)(B). No summons shall issue as to President Obama and the Clerk of Court is directed to amend the caption to reflect his dismissal from this action. Plaintiff's claims shall proceed against Ms. Ward, Operation Supervisor of Social Security Administratio n Brooklyn Card Center. The United States Marshal Service is directed to serve the summons, complaint, and this Order upon the remaining defendant without prepayment of fees. A courtesy copy of the same papers shall be mailed to the United States Att orney for the Eastern District of New York. All pretrial matters are referred to Magistrate Judge Ramon E. Reyes, Jr. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
