ORDER: For the reasons stated in the enclosed Memorandum and Order, the court dismisses plaintiff's complaint in its entirety and grants defendant's 9 motion to dismiss. Although plaintiff paid the filing fee, the court certifies pursuan t to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for purpose of an appeal. Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court is respectfully requested to enter judgment in favor of defendant, serve a copy of this Memorandum and Order and the judgment on pro se plaintiff within two days of the date of this order, and close this case.
