For the reasons set forth in the attached Memorandum and Order, the Court adopts the 35 February 9, 2015 report and recommendation of Chief Magistrate Judge Steven M. Gold. The Court grant s in part and denies in part 27 defendant's motion to dismiss and compel arbitration. More specifically, the Court (1) grants defendant's motion to compel arbitration; (2) stays this action pending arbitration pursuant to Section 3 of the FAA; and (3) denies defendant's motion to transfer venue without prejudice to renewal if there is to be further litigation following arbitration.
