ORDER denying 28 Motion to Appoint Counsel and ORDER DISMISSING CASE: For the reasons set forth in the attached Memorandum and Order, Petitioner's request for relief under 28 U.S.C. § 2241 and his Motion for Appointment of Counsel are bo th denied as moot. The Clerk of Court is directed to enter judgment terminating this action. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
