Since petitioner has not made a substantial showing that his constitutional rights were denied, a certificate of appealability will not issue. See 28 U.S.C. § 2253(c)(2). Petitioner may request a circuit judge of the United States Court of Appeals for the Second Circuit to issue the certificate. Fed. R. App. P. 22(b)(1). The Court certifies pursuan t to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be in good faith, and therefore, in forma pauperis status is denied for the purpose of an appeal. Coppedge v. United States, 369 U.S. 438,444-45 (1962). The Clerk of Court is respectfully requested to enter judgment and close this case. So Ordered by Magistrate Judge Cheryl L.
