March 31, 2015 Opinion or Order Filing 22 ORDER ADOPTING REPORT AND RECOMMENDATIONS. Upon a careful clear error and de novo review of the record and Judge Orensteins well-reasoned and thorough Report and Recommendation, the court denies defendants objections, and affirms and adopts the Repor t and Recommendation in its entirety as the opinion of the court. Accordingly, the court grants defendants motion to dismiss the individual ADA claims against Mr. Honore and Mr. Slippen, and denies defendants motion made on the following grounds: (1) abstention based on a state action alleging overlapping facts; (2) untimeliness of the claims; and (3) failure to state a claim.
