Because plaintiff has failed to file proof of service with th e Court within sixty days of the previous Order, this case is hereby dismissed without prejudice for failure to prosecute pursuant to Federal Rule of Civil Procedure 41(b). November 23, 2015 Opinion or Order Filing 21 MEMORANDUM AND ORDER ADOPTING REPORT AND RECOMMENDATIONS: Accordingly, the Court adopts Magistrate Judge Scanlon's recommendation to deny Augustin's motion for default judgment. Augustin is granted leave to file an amended complaint within thirty (30) days of the date of this Order to address the deficiencies regarding Augustin's allegations of willfulness described above. If Augustin files an amended complaint, he must serve his amended complaint on Apex in conformance with the procedures identified in the R&R. If Apex again fails to respond, Augustin may again move for a default judgment. If Augustin fails to file an amended complaint within thirty (30) days, the action will be dismissed with prejudice. September 24, 2015 Opinion or Order Filing 19 MEMORANDUM AND ORDER ADOPTING REPORT AND RECOMMENDATIONS: On July 27, 2015, Magistrate Judge Scanlon issued the R&R. (D.E. # 15 , R&R.) In the R&R, Magistrate Judge Scanlon notes that a page may be missing from Augustin's complaint. (Id. at 2 n.2.) To facilitate review of a complete record and in light of Augustin's pro se status, before resolving the pending motion for default judgment the Court directs Augustin to file a complete copy of the complaint with the Court within ten days. March 6, 2014 Opinion or Order Filing 4 ORDER denying 2 Motion for Leave to Proceed in forma pauperis. For the reasons stated in the attached order and memorandum, Plaintiff's IFP application is denied without prejudice to renew. Within fourteen days of the filing of this Order, Plaintiff must either pay the filing fee or file an amended IFP application bearing the applicable docket number for the respective action. Any amended IFP application must contain detailed information as to income Plaintiff received from any sources within the past twelve months. No summons shall issue at this time, and all further proceedings shall be stayed for fourteen days. If Plaintiff fails to comply with this Order, the Magistrate Judge will recommend that the District Judge dismiss the action in which Plaintiff failed to comply. Ordered by Magistrate Judge Vera M.
