Filing 82 ORDER denying 41 Plaintiffs' Motion for Preliminary Injunction; granting 56 Defendant Port Authority's Motion to Dismiss for Failure to State a Claim. For the reasons discussed in the attached Memorandum and Order, the Court grants the Port Authority's motion to dismiss for lack of jurisdiction and denies Plaintiffs' cross-motion for a preliminary injunction. The Court dismisses the Amended Complaint as against all Defendants and grants Plaintiffs thirty (30) days to amend the Amended Complaint to allege facts sufficient to demonstrate standing. If Plaintiffs fail to file a second amended complaint, the Court will dismiss the action with prejudice. Ordered by Judge Margo K. Brodie on 8/8/2017. (Haji, Sara) |
