Ver a M. Scanlon, U.S.M.J., on January 3, 2017, are overruled and the R & R is adopted in its entirety. Accordingly, Defendant's motion is granted in part and denied in part; Plaintiff's claim brought under the Magnuson-Moss Warranty Act, 15 U .S.C. § 2301 et seq., is dismissed and Defendant's motion otherwise is denied.
