ORDER denying 14 Motion to Dismiss; granting in part and denying in part 18 Motion for Discovery --- For the reasons set forth in the ATTACHED WRITTEN MEMORANDUM AND ORDER, SGU's motion to dismiss is denied. Service upon Ricciardi is qua shed and Plaintiff's motion for an extension of time to serve SGU is granted. Plaintiff's motion for limited discovery is denied as moot. Plaintiff has until April 30, 2018 to effectuate proper service on SGU. This matter is referred to the magistrate judge for further pretrial proceedings.
