MEMORANDUM AND ORDER, For the reasons that follow, his complaint (ECF Dkt. No. 1) is dismissed without prejudice, and with leave to amend in accordance with the terms of this Order. If Marchand elects not to file an amended complaint, or neglects to do so in a timely fashion, this docket will be closed for administrative purposes. Alternatively, and perhaps the neater and easier course for him, Marchand may withdraw this complaint and file a new complaint at such time as he has received a final decision from the Commissioner, as herein described. Marchand is reminded that, after receiving a final decision from the Commissioner through either of these two methods, he has 60 days to file a new federal court complaint seeking review of that f inal decision. All proceedings in this Court on this complaint shall be stayed until further order of the Court. The Court certifies, pursuant to 28 USC sec. 1915(a)(3), that any appeal would not be taken in good faith, and, therefore, in forma pauperis status is denied for the purpose of an appeal.
