December 1, 2017 Opinion or Order Filing 4 ORDER DISMISSING CASE: For the reasons stated in the attached, the Complaint is dismissed without prejudice for lack of subject matter jurisdiction pursuant to Fed. R. Civ. P. 12(h)(3). The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that an appeal would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
