March 9, 2018 Opinion or Order ORDER granting #8 Motion for Leave to File: No pre-motion conference letter is needed. Plaintiff's motion for leave to take discovery prior to holding a Rule 26(f) conference is granted. Plaintiff may promptly serve defendant Doe's ISP, Spectrum (Time Warner Cable), with a Rule 45 subpoena compelling them to provide plaintiff with the true name and address of the subscriber associated with IP address 24.90.18.167. The ISP should not provide any other information at this time, including Does telephone number and email address. Any information produced by the ISP, however, will be limited to review on an attorneys'-eyes-only basis and shall not be disclosed to plaintiff, or its employees or agents, with the exception that disclosure may be made as required for the limited purpose of effecting service of process on the Doe defendant. Plaintiff shall attach a copy of this Order to the subpoena it issues to Spectrum (Time Warner Cable). In addition, plaintiff may use the information disclosed in response to the Rule 45 subpoenas served on Spectrum (Time Warner Cable) only for the purpose of protecting and enforcing plaintiff's rights as set forth in its complaint and only for the above-captioned action and no other purpose, including, but not limited to, future litigation against the same defendant. The subpoena shall be subject to all of the procedural protections included in the proposed order submitted by plaintiff as Docket Entry 8-5, and a copy of this Memorandum and Order and that proposed order shall be served with the subpoena. Upon receipt of the subpoena, Spectrum (Time Warner Cable) has 60 days to serve a copy, along with a copy of the attached Memorandum and Order, upon the subscriber(s) it determines to be associated with defendant Doe's IP address. The subscriber will then have 60 days to file any motions with this Court contesting the subpoena, including a motion to quash or modify the subpoena; if defendant Doe so moves, Spectrum (Time Warner Cable) shall not turn over any information to plaintiff until defendant Doe's motion(s) have been addressed. If a motion is filed before that date, Spectrum (Time Warner Cable) shall preserve any subpoenaed information pending the resolution of the motion. If defendant Doe does not challenge the subpoena within 60 days of its receipt, Spectrum (Time Warner Cable) shall have 10 days to either produce information responsive to it to plaintiff or shall file its own motion challenging the subpoena. Upon receipt of information responsive to the subpoena, plaintiff shall have 60 days to serve defendant Doe. Ordered by Magistrate Judge Vera M. Scanlon on 3/9/2018. (Scanlon, Vera)
