MEMORANDUM DECISION AND ORDER dated 9/9/18 that the motion of the United States immunity 20 is granted. This ruling appears to leave no further basis for subject matter jurisdiction over plaintiffs claim against ISN and Fazio except supplemental jurisdiction. In the early stage of a case, as is this one, the preferred disposition is to decline supplemental jurisdiction without prejudice to a plaintiffs pursuit of the claim in state court. See 28:1367; United Mine Workers of Am. v. Gibbs, 383 U.S. 715, 726 (1966).
