EDNY Mediators are compensated in accordance with EDNY Local Civil Rule 83.8(f)(1)[formerly EDNY Local Civil Rule 83.11(f)(1)]. The Confidentiality Stipulation must be signed at the mediation session by all participants, including the mediator, and sent via email to Robyn_Weinstein@nyed.uscourts.gov. The Confidentiality Stipulation is available at: https://www.nyed.uscourts.gov/adr-forms. Upon completion of the mediation, both parties must submit a Mediation Report which can be found at: https://www.nyed.uscourts.gov/adr-forms. SCHEDULING ORDER: As discussed during the 9/6/2018 conference (see attached order for additional detail and deadlines), all discovery must be completed by 7/1/2019. On or before 7/1/2019, the Parties will file a joint status report letter confirming that discovery is complete. On or before 7/15/2019, the Parties will initiate any dispositive motions in accordance with the Individual Rules of the District Judge. On or before 9/15/2019, the Parties will file their joint Proposed Pretrial Order. An in person Status Conference is set for 3/6/2019 at 10:30 AM in Courtroom 13A South before Magistrate Judge Vera M. Scanlon. The 10/5/2018 conference is canceled. On or before 2/27/2019, the Parties will file a joint status report letter, of no more than three pages, identifying any outstanding discovery disputes. In light of the pending consolidation of these cases, the complaint/motion to dismiss schedule is reset: complaint due in all three cases: 10/1/2018; If the case is consolidated, Plaintiff to file amended complaint in Thomas and the initial complaint if Frasier. Motion to dismiss briefing for all three cases: Defendant to move by 10/15/2018; Plaintiff to oppose by 10/29/2018; Defendant to reply by 11/12/018. To be filed per the District Judge's Rules.
