October 19, 2018 Filing 9 Minute Entry for proceedings held before Magistrate Judge Peggy Kuo. Initial Conference held on 10/19/2018. Attorney Kareem R. Vessup appeared on behalf of plaintiff. Attorney Joseph S. Fritzson appeared on behalf of defendants. Plaintiff's counsel stated that plaintiff was taken to the Emergency Room at Jamaica Hospital, immediately after the incident in question. She sustained injuries to her shoulder, knee and ankles but no surgery was needed. Plaintiff was out of work for about two months and the damages claimed are based on the two jobs she had at the time of the incident. Defense counsel stated that the corporate defendant, Bunzl Dist., is the owner of the car defendant Juan Gonzalez was driving. Defense counsel also stated that plaintiff's minor daughter was present at the time of the incident and may be subpoenaed to testify. If the parties determine that it is necessary, they will request a hearing regarding her ability to testify. The attached Scheduling Order was entered setting deadlines for discovery and other pretrial proceedings. A settlement conference will be held on April 12, 2019 at 2:00 pm in Courtroom 11C South, before Magistrate Judge Peggy Kuo. Plaintiff must be present. A representative of the defendants with complete settlement authority (other than counsel) must be present, unless leave is granted to participate by phone. The parties must submit confidential ex parte settlement statements, which must include the last offer and demand, via email to Chambers (kuo_chambers@nyed.uscourts.gov) by April 4, 2019. For further guidance on the required content of the settlement statements and where to send them, the parties are directed to Judge Kuo's Individual Practice Rules. The parties were directed to file a joint status report by February 5, 2019 reporting on the progress of discovery and raising any issues which need to be addressed. (FTR Log #3:09-3:26.)
