ORDER. As contemplated by the parties' joint #7 Letter filed by Commissioner of Social Security requesting a slightly revised schedule for these proceedings, the court revises its May 8, 2020 scheduling order as follows: (1) Commissioner to serve and file the administrative record, which shall constitute defendant's answer, or otherwise move, on or before August 5, 2020; (2) plaintiff to serve his motion within 60 days of service of the administrative record; (3) Commissioner to serve his response within 60 days of service of plaintiff's motion; and (4) plaintiff to serve his reply, if any, within 21 days of Commissioner's response, and the parties shall file the entire set of motion papers, the stipulations of fact, and the administrative record with the court. ORDER. The court grants plaintiff's #2 Motion for Leave to Proceed in forma pauperis. The Clerk of Court is directed to serve the complaint upon the defendant without prepayment of fees. Defendant shall obtain and serve upon the plaintiff the administrative record of the proceedings, which shall constitute defendant's answer, or otherwise move against the complaint within ninety (90) days of commencement of this action, i.e. by August 5, 2020. If defendant is unable to file the record by that date, then defendant shall notify the court in writing before the ninety days expires. Defendant shall move for judgment on the pleadings, unless otherwise directed by the court, by service of motion papers upon plaintiff within sixty (60) days of service of the administrative record upon the plaintiff. Plaintiff's response papers shall be served upon defendant within sixty (60) days thereafter. Within twenty-one (21) days of receipt of plaintiff's response, defendant shall serve its reply on plaintiff, and the parties shall file the entire set of motion papers, the stipulations of fact, and the administrative record with the court.
