ORDER TO SHOW CAUSE. Plaintiff is hereby ORDERED TO SHOW CAUSE by 2/23/2021 why this case should not be transferred for improper venue. Neither plaintiff nor defendants reside in this district, and no events giving rise to the claim are alleged to have occurred here. Further, it appears to this Court that there are at least two districts in which this action could have been brought the District of New Jersey and the District of Columbia. Accordingly, this district is not an appropriate venue for plaintiffs action. See 28 U.S.C. 1391. Plaintiff presumably filed this action here because he wants it to be consolidated for pretrial proceedings in the multi-district litigation action, In re: Propecia (Finasteride) Products Liability Litigation, 12-md-2331. Consolidation is overseen by the Judicial Panel of Multidistrict Litigation, pursuant to 28 U.S.C. 1407, and any such transfers constitute a change of venue to the transferee court for pretrial purposes only. See In re Plumbing Fixture Cases, 298 F. Supp. 484, 495 (J.P.M.L. 1968). Complaints may not be filed directly with the transferee court if the district in which it sits would not otherwise be a proper venue for the action. Ordered by Judge Brian M. Cogan on 2/9/2021. C/M (Weisberg, Peggy) |
