ORDER TO SHOW CAUSE. Plaintiffs are hereby ORDERED TO SHOW CAUSE by 8/25/2021 why this case should not be dismissed for improper joinder, or dismissing most of the defendants except one group of defendants who worked in concert, without prejudice to refiling against each group of defendants who are alleged to have worked in concert. Plaintiffs allege that defendants engaged in separate, but fundamentally similar schemes. Such allegations demonstrate that plaintiffs' claims against the different defendants are not transactionally related. See Fed. R. Civ. P. 20(a)(2); Scott v. Chipotle Mexican Grill, Inc., 954 F.3d 502, 520 (2d Cir. 2020). There are no allegations that the named defendants were all part of a single scheme, organized in a hierarchical structure, with profit sharing of any kind. None of the causes of action are for RICO against all the defendants together. Defendants are not properly joined in cases such as this one simply because they are alleged to have separately filed fraudulent claims pursuant to similar schemes, and suing them all in one action makes the case unmanageable. See Am. Transit Ins. Co. v. Bilyk, No. 19-CV-5171, 2021 WL 216673, at *4-6 (E.D.N.Y. Jan. 21, 2021). Ordered by Judge Brian M. Cogan on 8/18/2021. (Weisberg, Peggy) |
