ORDER DISMISSING CASE. Plaintiff filed a complaint on January 27, 2023, and failed to respond to this Court's Order on February 7, 2023 denying his motion for leave to proceed in forma pauperis and directing him to pay the filing fee or to file the Court's long-form IFP application by February 28, 2023. Therefore, it is hereby ordered that the case be dismissed without prejudice for failure to prosecute pursuant to Fed. R. Civ. P. 41. The Clerk of Court is respectfully directed to enter judgment, close the case, mail a copy of this Order to pro se Plaintiff and note the mailing on the docket. For the reasons set forth in the attached Order, Plaintiff's IFP application is denied without prejudice to file an amended IFP application or pay the filing fee. In order to proceed with this action, Plaintiff must do either of the following within 21 days: (a) file the Court's long-form IFP application, a copy of which is attached to this Order, or (b) pay the $402 filing fee to the Clerk of Court.If Plaintiff fails to comply with this Order within the time allowed, and without showing good cause for an extension of time, the Court will dismiss the case without prejudice.
