ORDER re: #9 . Plaintiff may have until 8/12/24 to move, but no longer, since the Court has no reason to believe anyone will appear for defendant. As plaintiff recognizes, there is no "insurance carrier exception" in the federal rules. With regard to efficiency, it's not efficient to keep this matter open while defendant is in default, and if someone finally shows up, defendant will have to pay plaintiff's costs and fees for the delay it caused. Finally, with regard to class certification, if plaintiff believes it does not have grounds to seek class certification without obtaining discovery from defendant, he can pursue his remedies, but it can be difficult to get a class against a defendant that won't respond to legal process.
