Filing 42 MEMORANDUM AND OPINION: For the reasons set forth in the attached Memorandum and Order, I award plaintiff, John Saporito, $370,136.24 in past pain and suffering, $29,863.76 for past medical expenses, and $350,000 for future pain and su ffering and medical expenses for a total award of $750,000. The clerk of the court is directed to enter judgment for plaintiff in accordance with this order and the order issued on September 21, 2011. Ordered by Magistrate Judge William D. Wall on 9/30/2013. Filing 26 MEMORANDUM AND OPINION: For the reasons set forth in the attached Memorandum and Order,the court finds in favor of the plaintiff John Saporito. Accordingly, the damages phase of the trial must be conducted. The parties shall participate in a telep hone conference on 10/20/11 at 2:00 p.m. to schedule further proceedings. Plaintiffs' counsel shall initiate the call and have all parties on the line before connecting with the court at (631) 712-5720. Any request to adjourn this conference m ust be electronically filed as a Motion and must include proposed alternative dates acceptable to all parties.
