ORDER granting 12 Motion to Dismiss: Defendants' motion to dismiss the Equal Protection class of one claim is granted with prejudice. The motion to dismiss the Equal Protection claim based on malice is granted without prejudice. Plaintiffs m ay move to amend the complaint as to this latter claim within twenty days of the date hereof. To the extent no motion to amend is made, the Court will issue an order declining to exercise jurisdiction over Plaintiffs' state law claim based on Municipal Law 239-m and said claim will be dismissed without prejudice.
