Filing 56 MEMORANDUM & ORDER: For the reasons set forth in the attached, the Court enters summary judgment in favor of the estate of Alfred A. Kettenbeil. The Clerk of the Court is directed to release the death benefit deposited by New York Life Insurance Co. to the Estate. Ms. Dorfman's motion to file an interlocutory appeal in forma pauperis is denied pursuant to 28 U.S.C. § 1915(a)(3), as such an appeal would not be taken in good faith. Coppedge v. United States, 369 U.S. 438, 444-45 (1962). Ordered by Judge Pamela K. Chen on 9/6/2013. (Galeotti, Matthew) |
