ORDER ADOPTING REPORT AND RECOMMENDATIONS; denying 71 Motion for Default Judgment; granting 73 Motion to Set Aside Default: Pursuant to 28 U.S.C. § 636(b) and Fed. R. Civ. P. 72, this Court has reviewed the R&R for clear error, and finding n one, now concurs in both its reasoning and its result. As such, the Court adopts the August 29, 2019 R&R of Judge Brown as if set forth herein. Accordingly, IT IS HEREBY ORDERED that Defendant's motion to vacate the default judgment is granted and Plaintiff's motion for default judgment is denied.
