MEMORANDUM & ORDER granting in part and denying in part 10 Motion to Dismiss for Failure to State a Claim; denying 22 Motion for Extension of Time to File. For the foregoing reasons, Defendants' motion to dismiss is GRANTED IN PART and DENIED IN PART and Plaintiff's cross-motion to file a late notice of claim is DENIED.
