MEMORANDUM & ORDER ADOPTING REPORT AND RECOMMENDATION; For the foregoing reasons, Judge Brown's R&R (Docket Entry 24) is ADOPTED in its entirety, Plaintiff's Objections (Docket Entry 26) are OVERRULED, Plaintiff's motion seeking a de fault judgment (Docket Entry 18) is DENIED, and Defendant's motion to vacate (Docket Entry 16) is GRANTED. Since Defendant already filed an Answer on October 21, 2015, (Docket Entry 21), the parties are directed to consult Judge Brown's Individual Motion Practices to schedule a discovery conference. ORDER granting 2 Motion for Leave to Proceed in forma pauperis; Plaintiff's application to proceed in forma pauperis is GRANTED and the Court ORDERS service of the Complaint by the United States Marshal Service without prepayment of the fil ing fee. The Clerk of the Court shall forward the Summons, the Complaint, and this Order to the USMS and the USMS shall serve the Defendant. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be take n in good faith and therefore in forma pauperis status is DENIED for the purpose of any appeal.
