ORDER ADOPTING REPORT AND RECOMMENDATIONS : IT IS HEREBY ORDERED that plaintiff's motions for a default judgement against defendant EBE of NY, Inc. and for summary judgment against defendant James Wrenn declaring there is no coverage are grant ed. The Clerk of Court is directed to enter judgment declaring that there is no coverage under Underwriters' policy for Wrenn's claim in the action currently pending in New York State Supreme Court, Nassau County, styled James Wrenn v. AB C Corp d/b/a Vapor Smoke Shop, and bearing Index No.: 601450/2016 (the Underlying Action), and that Underwriters are not under a duty to defend or indemnify EBE or any other party with respect to the Underlying Action.
