MEMORANDUM & ORDER denying 3 Motion for TRO; granting 2 Motion for Leave to Proceed in forma pauperis; For the reasons set forth above, Plaintiff's application to proceed in forma pauperis is GRANTED and his application for a Preliminary Injunction is DENIED. The Court ORDERS that the Clerk of the Court serve a copy of the Complaint together with this Order on the Suffolk County Attorney. Plaintiff's Section 1983 claims against the First Precinct are DISMISSED WITH PREJUDICE p ursuant to 28 U.S.C. §§ 1915(e)(2)(B)(ii), 1915A(b)(1). The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is DENIED for the pu rpose of any appeal. The Clerk of the Court is directed to amend the caption as outlined supra at 1, n.1 and n.2. The Clerk of the Court is further directed to mail a copy of this Order to the pro se Plaintiff.
