The Court grants in part and denies in part the attorney's fees motion, and awards the Plaintiff attorney's fees in the amount explained in the Second R&R. Filing 37 MEMORANDUM OF DECISION & ORDER: For the foregoing reasons, the Court sustains the Plaintiff's objection as to costs and overrules the Plaintiffs objection as to attorney's fees. The Court adopts in part the R&R to the extent that it recomme nds: (a) granting the Plaintiffs motion for default judgment of foreclosure and sale; (b) appointing Kathryn C. Cole, Esq. to serve as referee to effectuate the sale of the property; and (c) denying, without prejudice to renewal, the Plaintiff's motion for attorneys fees.
