ORDER ADOPTING REPORT AND RECOMMENDATION:For the reasons stated above, the Court accepts the recommendations set forth in Magistrate Judge Shields' R&R. Plaintiffs' motion for summary judgment is granted and Defendant Arenas' counterc laim is dismissed in its entirety. The Court denies Plaintiffs' motion to strike Arenas' July 24, 2020, letter but disregards that letter as an unauthorized sur-reply. The Court also denies Plaintiffs' motion that sanctions be imposed on the pro se defendant, Arenas. Plaintiffs are directed to serve a copy of this Order on defendant Arenas and file proof of service with the Clerk of Court forthwith. Ordered by Judge Roslynn R. Mauskopf on 3/29/2021.
