ORDER DISMISSING CASE: Accordingly (PLEASE SEE ORDER FOR FURTHER DETAILS), so as to no longer further delay the state court proceedings, the complaint is summarily remanded to the Fifth District Court, County of Suffolk. The Clerk of the Court is directed to: (1) mail a copy of this order to all parties and to the Clerk of the New York State Fifth District Court, Suffolk County, pursuant to 42 U.S.C. 1447(c), and (2) close this case. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that, should Bustamante seek leave to appeal in forma pauperis, any appeal would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
