MEMORANDUM AND ORDER. The Court lacks subject matter jurisdiction over the plaintiffs claims. Accordingly, the complaint is dismissed without prejudice pursuant to Fed. R. Civ. P. 12(h)(3). The plaintiff's request for injunctive relief is denied as moot. The Clerk of Court is respectfully directed toenter judgment. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal would not be taken in good faith, and therefore, in forma pauperis status is denied for the purpose of any appeal.
