January 27, 2022 Opinion or Order ORDER DISMISSING CASE. By Order dated January 10, 2022, the Court denied Plaintiff's application to proceed in forma pauperis (IFP) without prejudice and with leave to renew upon completion of the AO 239 Long Form IFP application ("Long Form") attached to the Order. (See Order, Docket Entry #6 .) It also provided that, alternatively, Plaintiff may remit the $402.00 filing fee. Plaintiff was directed to comply with the Order within fourteen (14) days and was warned that a failure to timely comply with this Order may lead to the dismissal of the complaint without prejudice for failure to prosecute pursuant to Federal Rule of Civil Procedure 41(b). (Docket Entry #6 at 2.) The Order was mailed to Plaintiff at his address of record and has not been returned to the Court as undeliverable. To date, Plaintiff has failed to respond to the January 10, 2022 Order. Accordingly, it appears that Plaintiff is no longer interested in pursuing this case and thus it is HEREBY ORDERED that: (1) this case is DISMISSED for failure to prosecute and for failure to comply with the Courts Order; and (2) the Clerk of the Court shall enter judgment dismissing the Complaint pursuant to Federal Rule of Civil Procedure 41(b) and mark this case CLOSED. The Clerk of the Court shall also mail a copy of this Electronic Order to Plaintiff at his address of record. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this Electronic Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
