Civil Case Terminated, case closed. (JC) |
ORDER granting #6 Motion for Leave to Proceed in forma pauperis. While the Court hereby grants the IFP application, review of the action reveals that this petition, filed under 28 USC Sec. 2241, attempts to attack a post-verdict, pre-sentence federal indictment and conviction, and therefore fails to state a claim. Thus, the matter is dismissed consistent with the Court's obligations under 28 USC Sec. 1915(e)(2)(B). The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of the Court is directed to mail a copy of this Order to the defendant and close the case. Ordered by Judge Gary R. Brown on 2/14/2023. (Brown, Gary) |
