Plaintiff's Monell claims are severed and stayed pending resolution of plaintiff's other claims. The Court set the following discovery schedule: The parties shall serve interrogatories and written discovery requests by 03/31/2023; respond to interrogatories and produce discovery by 04/29/2023; and complete depositions by 05/31/2023, the date fact discovery ends. February 24, 2023 Opinion or Order ORDER re: #16 . Defendants' portion of this letter is so useless that sanctions are appropriate under Rule 16(f). If all the Court wanted by ordering a joint letter stating the facts of the case as seen by each party was a general denial, it could just look at defendants' answer. Plaintiff has set forth facts alleging in great detail that he was attacked with great brutality, and defendants have not even told the Court if they were in the same room. Do they deny any encounter at all occurred? Is there alibi evidence that would defeat plaintiff's claims? Was the incident reported? Was no investigation done? Defendants are ORDERED to file a supplemental letter prior to the conference that explains defendants' position, failing which a sanction will be imposed for failure to comply with this Court's Order in good faith. Ordered by Judge Brian M. Cogan on 2/24/2023. (PW)
