October 7, 2019 Opinion or Order Filing 5 TEXT ORDER denying #3 Plaintiff's request for an Order to Show Cause, denying without prejudice the first portion of #3 Plaintiffs motion for a preliminary injunction (which requests expedited discovery of all correspondence regarding his application for disability benefits pursuant to 38 U.S.C. 1151), reserving decision on the remaining portion of #3 Plaintiff's motion for a preliminary injunction (which requests an award of disability benefits pursuant to 38 U.S.C. 1151 during the pendency of this action), pending a response by Defendant. Plaintiff's request for an Order to Show Cause is unsupported by a showing of good cause why the standard Notice of Motion procedure cannot be used (as well as a showing of good cause and substantial prejudice that would result from the requirement of reasonable notice of the application), as required by Local Rule 7.1(e) of the Local Rules of Practice for this Court. (Dkt. No. #3 .) Among other things, he has not persuaded the Court that requiring service and a response would so prolong this proceeding as to preclude him from receiving benefits during his lifetime. As to Plaintiff's requests for relief, his first request (i.e., for expedited discovery) is denied without prejudice as unsupported by a showing of good cause: the appropriateness of expedited discovery is, under the circumstances, better decided by Magistrate Judge Stewart. Moreover, decision is reserved on Plaintiff's second request (i.e., for an award of benefits between the decision on his motion for a preliminary injunction and the entry of a judgment in this action), pending service of Plaintiff's Complaint, his motion and this Text Order on Defendant (following Magistrate Judge Stewart's decision of Plaintiff's motion to proceed in forma pauperis). Defendant's response papers shall be due within TEN (10) DAYS after service by Plaintiff. The Court will sua sponte schedule a hearing on Plaintiff's motion should it determine that oral argument and/or witness testimony is necessary. SO ORDERED by Chief Judge Glenn T.
