March 10, 2022 Filing 19 TEXT ORDER directing the parties to show cause why this case should not be remanded to state court for lack of subject matter jurisdiction. Plaintiff commenced this action on December 8, 2021, in New York State Supreme Court, Warren County, seeking to collect a debt of $4,194.42 from Defendant that had been assigned to Plaintiff from Citibank, N.A. See Dkt. No. 2. Plaintiff filed a notice of removal on January 20, 2022, and filed an answer with counterclaims on February 3, 2022. See Dkt. Nos. 1, 13. A notice of removal must allege a proper basis for removal under 28 U.S.C. 1441 to 1445. See Agyin v. Razmzan, 986 F.3d 168, 181 (2d Cir. 2021). "[In] determining whether jurisdiction is proper, we look only to the jurisdictional facts alleged in the Notices of Removal." Id. (citation omitted). A defendant may remove a civil action brought in state court to a federal court in "any civil action... of which the district courts of the United States have original jurisdiction." 28 U.S.C. 1441(a). A district court is required to evaluate "whether the plaintiff could have filed its operative complaint in federal court, either because it raises claims arising under federal law or because it falls within the court's diversity jurisdiction." Home Depot U.S.A., Inc. v. Jackson, 139 S. Ct. 1743, 1748 (2019). However, the Supreme Court has held that "[a] counterclaim... cannot serve as the basis for 'arising under' jurisdiction." Id. (quoting Holmes Grp., Inc. v. Vornado Air Circulation Sys., Inc., 535 U.S. 826, 831 (2002)). Here, the underlying state-court complaint brings claims sounding in breach of contract under state law. Although the parties are domiciled in different states, the amount in controversy is well-below the $75,000 baseline for the Court to exercise diversity jurisdiction. Moreover, while Defendant Cunningham has raised counterclaims asserting violations of federal laws, it is well settled that a counterclaim cannot serve to create federal court subject matter jurisdiction. As such, unless Plaintiff establishes that this Court has jurisdiction over this matter within fourteen (14) days of the date of this text order, this matter will be remanded to Warren County Supreme Court without further order from this Court.
