TEXT ORDER denying #27 Plaintiff's letter-motion without prejudice as unsupported by a showing of cause. TEXT ORDER: Court has reviewed the Docket and Dkt. Nos. #7 , #16 , #17 , #18 , #20 , #21 , and #22 , which are pending before the undersigned. To date, Plaintiff has not paid the filing fee to proceed with this action, and, therefore, Plaintiff's motions at Dkt. Nos. #7 , #18 , #20 , #21 , and #22 are DENIED without prejudice as procedurally improper and as premature. Upon review of Plaintiff's second and third motions for leave to proceed in forma pauperis ("IFP") (Dkt. Nos. #16 and #17 ), the Court finds the information Plaintiff has provided again demonstrates that Plaintiff is not unable to pay the filing fee associated with this action and, therefore, for the reasons set forth in Dkt. Nos. #4 and 9 , Plaintiff's motions for leave to proceed IFP (Dkt. Nos. #16 and #17 ) are DENIED. Plaintiff is reminded as per Dkt. No. #5 , should he wish to proceed with this action, he must pay the case's filing fee on or before 12/4/2019, and that failure to do so may result in an administrative closure of this case, or dismissal of this action for failure to prosecute and failure to obey a Court Order. TEXT ORDER denying the following four motions without prejudice as procedurally improper in that each is unsupported by either an affidavit or a memorandum of law: Plaintiff's "Motion to Counterclaim" (Dkt. No. #10 ); Plaintiff's Motion to Join (Dkt. No. #11 ); Plaintiff's Motion to Serve (Dkt. No. #12 ); and Plaintiff's Motion to Serve (Dkt. No. #13 ). Plaintiff's Motion to Amend his Amended Complaint (Dkt. No. #14 ) is denied without prejudice as unsupported by an affidavit, a memorandum of law, and a proposed Second Amended Complaint setting forth the proposed amendments through a redline/strikeout version of the Amended Complaint or through other equivalent means. The Clerk of the Court is directed to STRIKE Plaintiff's Second Amended Complaint (Dkt. No. #15 ) from the docket as having been filed without leave. Plaintiff's second appeal (Dkt. No. #19 ) is denied and dismissed as redundant of his first appeal (Dkt. No. #6 ), which the Court denied in its Text Order of 11/7/2019 (Dkt. No. 9 ). Those of Plaintiff's remaining motions that are pending before the undersigned shall be decided after Plaintiff pays the case's filing fee on or before 12/4/2019. Finally, Plaintiff is cautioned that, if he continues to file duplicative and vexatious motions in this action, he will be directed to show cause why he should not be barred from proceeding without counsel in this action. TEXT ORDER denying and dismissing Plaintiff's appeal from U.S. Magistrate Judge Therese Wiley Dancks' Order of 11/04/2019 (Dkt. No. #6 ), as unsupported by a showing of cause. Plaintiff points to no portion of Magistrate Judge Dancks' Order that is clearly erroneous or is contrary to law pursuant to Fed. R. Civ. P. 72(a). Plaintiff is respectfully advised that, even if it were proper for the Court to consider evidentiary material that had not been presented to Magistrate Judge Dancks (such as Plaintiff's SNAP application), the Court would render the same finding, under the circumstances. As for the pleading that Plaintiff filed on 11/06/2019 labelled "Amended Complaint," the Clerk is directed to STRIKE that pleading from the docket, because it is in fact a Second Amended Complaint (the first Amended Complaint having been filed on 10/28/2019), and it was filed without leave of the Court, in violation of Fed.
