The Court has authority to bind the parties to an agreement by which Defendants will not move to dismiss under Federal Rule of Civil Procedure 12(b)(6) if Plaintiff does not assert certain claims. See, e.g., Torres v. Int'l Hotels (Jamaica) Ltd., No. 04-CV-61729, 2007 WL 2254929, at *4 (S.D. Fla. Aug. 3, 2007); Clinton v. Marshall, No. 08-CV-4178, 2018 WL 1449387, at *3 (C.D. Cal.
