August 18, 2022 Opinion or Order Filing 6 LETTER BRIEF by Service Employees Pension Fund of Upstate New York. (Kornfeld, Daniel)
August 18, 2022 Opinion or Order Filing 5 TEXT ORDER: This case was flagged by Court staff as potentially related to case 5:20-CV-901-DNH-ML. The Clerk has provisionally reassigned it to the undersigned on that basis. However, the Court notes that the civil cover sheet filed in this action did not indicate the existence of any related case (Dkt. No. 1-2 at VIII). The Local Rules require parties filing a "related" action to comply with Section G of General Order 12, which governs relatedness. Notably, civil cases are not related merely because they involve the same parties or similar legal issues. To that end, plaintiffs' attorney is ORDERED to file a short letter brief, not to exceed three pages, which (1) explains whether this civil action is "related" to the 20-CV-901 action as defined by General Order 12(G)(2); and, if so, (2) explains why this action was not identified as "related" to 5:20-CV-901 on the civil cover sheet filed in this action. This letter brief shall be filed on or before Friday, August 19, 2022 at 12:00 p.m. The Court will make a final determination about the relatedness question in due course. SO ORDERED by Judge David N. Hurd on 8/18/2022.
