July 18, 2018	Filing 63 DECISION & ORDER: It is Ordered that the # 58 Motion to Dismiss for Failure to State a Claim is GRANTED in part and DENIED in part, the Court finds that this matter is about whether the Defendants are liable to the Decedent for violating the Eighth Amendment by failing to protect him and for failing to intervene when he was attacked by a fellow inmate. Claims addressing this issue will remain in the case. The motion is GRANTED with respect to Plaintiffs claims brought pursuant to the 14th Amen dment and with respect by any claims brought by the Plaintiffs on their own behalf, rather than on behalf of the Decedents estate. As such, Count 1 is hereby DISMISSED to the extent that it raises a Fourteenth-Amendment claim. Counts 4-9 of the Second Amended Complaint are also hereby DISMISSED.
