ORDERED that the following claims SURVIVE sua sponte review and require a response: (1) plaintiff's retaliation claim against defendant Raven; and (2) plaintiff's excessive force claim against defendant Raven. ORDERED that plaintiff's claims against the New York State Department of Corrections and Community Supervision are DISMISSED with prejudice pursuant to 28 U.S.C. 1915(e)(2)(B) and 28 U.S.C. 1915A(b) as barred by the Eleventh Amendment. ORDERED that all remaining claims are DISMISSED without prejudice pursuant to 28 U.S.C. 1915(e)(2)(B) and 28 U.S.C. 1915A(b) for failure to state a claim upon which relief may be granted. ORDERED that defendants DOCCS, Sgt Baker, DSS Baker, Maher, Abar, and Gausconi are DISMISSED without prejudice as defendants for the reasons set forth above. ORDERED that, upon receipt from plaintiff of the documents required for service, the Clerk shall issue a summons and forward it, along with a copy of the complaint, to the United States Marshal for service upon defendant Raven. The Clerk shall also forward a copy of the summons and complaint by mail to the Office of the New York State Attorney General, together with a copy of this Decision and Order.
